Terms of sale

These terms govern the sale and transfer of any .uk or .co.uk domain name listed on this site by Presence Group Ltd ("we", "us", "our"). By making an offer or agreeing to a price, you ("the buyer") accept these terms in full. If you do not accept them, do not make an offer.

1. Who we are

Presence Group Ltd is a company registered in England & Wales under company number 12120471, with its registered office at Eventus Business Centre, Sunderland Road, Market Deeping, Lincolnshire, PE6 8FD, United Kingdom. We are the registrant of the domain names listed on this site and we hold our own Nominet IPS tag, MIXUK, as a self-managed registrar.

2. Status of listings

Each domain listed is offered as an invitation to treat, not a binding offer for sale. Prices, availability and willingness to sell may change at any time without notice. A binding contract is formed only when we have confirmed in writing (by email from [email protected]) that we accept your offer for a specific domain at a specific price.

3. Making an offer

  1. Send your offer to [email protected], naming the specific domain and a sterling (GBP) figure exclusive of VAT and any payment-handler fees.
  2. We will respond within five working days to accept, decline or counter-offer. We are not obliged to accept any offer for any reason.
  3. If your offer is accepted, we will send a written confirmation specifying the agreed price, payment method, transfer mechanism and target completion date. That email and these terms together form the contract.

4. Payment

Payment is due in full and in cleared funds before any transfer is initiated. Accepted methods include UK bank transfer and, where mutually agreed, an escrow service such as Escrow.com or Sedo. Buyer pays any transaction or escrow fees unless we have agreed otherwise in writing. Domain prices may be subject to UK VAT at the prevailing rate; a VAT invoice will be issued where applicable.

5. Transfer mechanism

.uk and .co.uk domains are administered by Nominet UK. Transfer of ownership completes by IPS tag change to the tag of the buyer's chosen Nominet-accredited registrar. We will action the tag change within two working days of payment clearing. The buyer is responsible for ensuring their receiving registrar is ready to accept the domain at that tag.

Registry-level transfer of registrant details (the "registrant change") will be initiated by us in accordance with Nominet's processes once the tag change is complete. The buyer agrees to provide accurate registrant details for this purpose, including a verifiable name and postal address as required by Nominet's data quality policy.

Once the registrant change completes, the buyer becomes the registrant of record at Nominet and is bound directly by Nominet's terms and conditions of domain name registration. Buyers are expected to read those terms before completing a purchase.

We make no warranty as to traffic, search engine rankings, historical use, third-party trade marks or fitness for any particular business purpose. The buyer is responsible for their own trade-mark and due-diligence checks before completing a purchase.

8. Limitation of liability

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be limited. Subject to that, our total liability arising out of or in connection with the sale of any domain is limited to the price paid by the buyer for that domain. We are not liable for indirect, consequential or business losses (including lost profits, goodwill or anticipated savings).

9. Cancellation and refunds

Domains are unique digital assets. Once a tag change has been completed, the sale is final and non-refundable. If we are unable to transfer a domain after payment has been made (for example, due to a registry-level issue we cannot resolve), we will refund the price in full within fourteen days and the contract will terminate without further liability on either side.

Statutory consumer rights, where they apply, are not affected.

These terms and any dispute arising from them are governed by the laws of England & Wales, and the parties submit to the exclusive jurisdiction of the courts of England & Wales.
